Terms of Service for Art Commissions

Hey there! 👾 Thank you for considering my art services. These terms exist to ensure we’re on the same page and to make the process smooth, transparent, and enjoyable for both of us.

By commissioning me, you agree to these terms so please read them carefully🛐

1. Communication & Collaboration

🛸Teamwork makes the dream work: Commissioned art is a collaboration, so clear communication is key. The more details and references you provide upfront, the better I can bring your vision to life.

🛸Rush orders: If you’re on a tight deadline, I’ll need you to be extra responsive to my messages. Delays in feedback mean delays in progress!

2. References Are Your Best Friend

To avoid misunderstandings, please provide references for:

Characters: Hairstyle, eye shape, skin tone, body type, clothing, etc. (Pinterest can be really helpful for this!)

Backgrounds: Describe the mood, complexity, and elements you want. No references? I’ll use my creative freedom, but this means no revisions later.

Don’t skip this! If you don’t provide references, I’ll assume you trust my artistic judgment, and major changes won’t be possible after approval.

3. Service Overview

Digital Artwork: All artwork commissioned is digital only. No physical items will be shipped unless explicitly agreed upon.

Personal vs. Commercial Use: You are purchasing personal-use rights unless a commercial license has been explicitly negotiated and agreed upon.

4. Payment & Fees

PayPal (I'll send an invoice)

Vgen - accepts credit cards, etc (a platform against Ai where both clients and artists are protected)

🛸Full payment upfront in USD.

🛸Split payment:

If this is your first time commissioning me: Only via Vgen and only for amounts higher to $500. First payment is before I start working on the sketch, second payment is before I start working on the coloring.

If we worked together before:

You can choose PayPal or Vgen.

Two weeks: +100%

Character Design (If you don't have previous art of your character):

This fee will vary depending on the design you have in mind and how much creative freedom you'll give me.

The fee without any creative freedom given is +$100

If you like to choose between different sketches I can do it but I charge extra for every sketch. (Unless I gave it to you for free, there are more chances of getting extra sketches if I'm given creative freedom but it's not guaranteed).

5. Revisions & Changes

Sketch phase: This is the time for adjustments! You get two free minor changes (e.g., tweaking poses or expressions).

Major changes (like a full redesign, change of pose, redraw of the background, adding extra elements that will change the lighting of the entire piece) cost extra.

After completion: Only minor tweaks are free (e.g., slight color shifts). Bigger edits mean extra fees.

What counts as "minor tweaks/changes"?

Fixing small errors (like eye color if it’s not a super intricate design).

Adjusting contrast or expressions slightly. The expressions part depends if the character's skin is a simple one or a complex one.

6. Artist’s Rights

I retain copyright to all artwork unless we agree otherwise (for an additional fee).

Usage: I can post the art in my portfolio/socials, use it for promotions and so on unless you request privacy (privacy fee applies).

7. Client’s Rights

Personal use: You can print it, use it as icons, or post it online (with credit, including linking to my social media or tagging me).

Don’t: Edit my work, resell it, or use it commercially without permission. Please don't remove my signature.

If the artwork is intended for commercial use (e.g., selling prints, using it for merchandise, Twitch or YouTube content, basically if you're making money out of it), a separate commercial license must be purchased. The terms and fees for commercial use will be discussed and agreed upon before the work begins.

The commercial license will vary depending on the scope and nature of the commercial use, and failure to disclose commercial intent upfront may result in legal action and/or cancellation of the commission.

NSFW Content: If you are commissioning NSFW content, you confirm that you are 18 years or older. I reserve the right to refuse any NSFW content that I find inappropriate or unethical.

8. Moral, Ethical Boundaries & Ai usage

I won’t create art that promotes themes against my values (racism, hate towards the lgbtqia+ community, glorification of SA, p3dophilia and so on).

Misuse has consequences. If you use my art unethically, you’ll lose all rights to it.

No AI, ever. My art is handmade, I don't use Ai to make my art.

Please don’t use my art to train AI or generate Ai.

Don't use it for NFT either, please.

9. Deadlines & Timeframes

I’ll give you an estimated timeline based on my waitlist. If anything were to delay me(life happens) I’ll keep you updated.

Need it by a specific date? Rush slots may be available for an extra fee, please consult with me before placing your order.

10. Refunds & Cancellations

Full refunds are only allowed if I didn't start working on your commission yet. A 25% cancellation fee will be applied unless I'm the one canceling the commission.

No refunds after the artwork is completed and delivered.

Chargebacks = instant blacklist. Let’s talk first if there’s an issue!

11. Confidentiality & Privacy

Client Information: Any personal information shared during the commission process (such as your PayPal address, email, real name and country) will remain confidential and will not be shared with third parties.

Private Commissions: If you wish to keep your commission private and do not want it shared publicly in my portfolio or on social media, please inform me in advance. A privacy fee may apply for private commissions.(+$100)

12- Extras

Timelapses/Files: Want the process video or original .CSP file? Please ask before I start because it costs extra and I need to turn on the timelapse feature before I start working on the piece.

By commissioning me, you are acknowledging that you have read, understood, and agreed to all the terms and conditions outlined in this document. Failure to comply with these terms may result in the cancellation of your commission, refusal of future commissions, or legal action where applicable.

If you're a creator who is in favor of romanticizing/glorifying abuse against minors, abuse against minorities/disabled people and lgbtqia+ people, etc please don't contact me. I don't support that kind of content and even if the art you commission from me has none of those themes, if I find out you're in favor of it and plan to use my art in any book that has those themes I'll pursue legal action.

Tips for a better experience

Please provide as many references as you can if you want me to draw your original character.

You can use Pinterest to search for clothes, pose, color palette, length of the hair, skin tone, similar looking characters and so on. The more specific your request is, the more accurately I'll be able to portray them.

If the type of commission you want is not on my examples or on my Instagram or youtube (@ahkizyans) don't worry. There are a lot of illustrations I don't post because they don't match what my followers want to see but chances are I have worked on themes like that before. (And a lot of illustrations I can't post on Instagram because of the guidelines).

In the rare case where I didn't reply:

Instagram sometimes hides dm requests for up to 4-6hs so if I didn't reply you can try Ahkizyans@gmail.com where I always try to reply as soon as I see it. If I take more than 48hs don't hesitate to send another email. I don't check tiktok/yt/x/discord regularly so avoid contacting me via there unless we agreed on it (Discord is better for nsfw commissions)
